Loveland Youth Vaping Taskforce 

The Youth Vaping Taskforce was convened by City Council on April 2, 2019, during a meeting to amend the City's municipal code’s definition of tobacco products to include electronic vaping devices. The taskforce held a total of 10 meetings between June 2019 – August 2020 to share information, analyze local and national trends, review changes in state and federal legislation and gather feedback from both the public health and industry sides of this issue.

The Youth Vaping Taskforce presented information to City Council at two study sessions on November 19, 2019 and September 8, 2020, to outline the problems around youth vaping and to propose solutions in the form of two draft ordinances. Links to those agendas and materials can be found  below:

Public Discussion Continued...

Both of the draft ordinances were brought to City Council for first reading on November 17, 2020. These ordinances would require:
- an annual licensing fee
- 500 feet distance requirement from youth populated areas
- age restrictions of 21 to purchase tobacco products
- no self-service sales
- two compliance checks each year, and
- a penalty structure for violations

Public comment occurred during this meeting, but no vote was taken as the matter was continued to the November 24, 2020 City Council meeting, due to time constraints. 

Council Votes to Ban Flavored Tobacco Products

On November 24, 2020 the Loveland City Council decided, by a 6-3 vote, to adopt on first reading Ordinance No. 6443 (A), which would prohibit the sale of all flavors in the City (except plain tobacco flavor). Passage of (A) would also require every establishment currently selling any Tobacco Products to obtain a City License. No establishment would be permitted to sell any Flavored Tobacco Products whatsoever.

The City Council took public comment and asked questions during the December 1, 2020 Regular City Council meeting, but closed without voting on the ordinance due to time constraints. 

On the December 8, 2020 City Council meeting the Council held a special meeting to conclude public comment on proposed Ordinance A. At that time, Council directed City staff to obtain additional retailer feedback on the issue of youth vaping and proposed solutions. 

Tobacco Retailer Outreach - Roundtable Summary and Survey Results

Culminating an extensive public involvement process to address  youth vaping in Loveland, two Tobacco Retailer Roundtables were held during the last week of January 2021.  Both roundtables were conducted remotely and held during varying days and times to maximize attendance.  The Tobacco Retailer Roundtable Report summarizes the input received from the roundtable participants.

In addition to the two roundtables, Loveland Tobacco Retailers were also given the opportunity to provide input through a brief survey. The retailer responses have been summarized and are contained within the linked Tobacco Retailers Survey Results

Youth and Family Outreach - Next Steps

At the February 2, 2021 City Council meeting, the Council approved a motion to further postpone the second reading of the flavored tobacco ordinance. The postponement is intended to provide Loveland residents with children or family members adversely impacted by tobacco use, an opportunity to speak on the issue.

With this direction from Council, City staff is undertaking similar efforts to those used for the tobacco retailers (roundtable and surveys), to gather input from this population. The results of this outreach effort can be viewed in the Community Tobacco Roundtable Report as well as the summary of the Community Tobacco Survey results (Adult Survey Responses and the Youth Survey Responses). These findings will be presented to City Council along with the previously collected data on April 20, 2021.

Since the Council vote on Ordinance A was continued until the April 20 meeting, the public comment portion of this item has concluded. In the time between the December 8, 2021 meeting and the April 20, 2021 meeting, all additional public input emailed to City Council will be linked in the Agenda Item Report.
